02Accepting these terms

By using this website you accept these terms. If you do not accept them, please do not use the site.

We may update these terms from time to time. The version published here is the one that applies.

03What this website is

This site describes the services we offer. It is information about our business, not an offer capable of being accepted, and nothing on it creates a contract between us.

We try to keep everything here accurate and current, but we do not warrant that it is free of error or omission.

04Prices shown here

Prices on this site are starting points, published so you have a realistic idea of cost before you get in touch. They are not quotations and they are not fixed.

What you actually pay is set out in a written quotation for your specific project. Where a published price and a written quotation differ, the written quotation is the one that counts.

All prices are in United States Dollars. Where a client is required by Zimbabwean tax law to withhold an amount from payment and remit it to the Zimbabwe Revenue Authority, that is dealt with in the service agreement.

05The work is governed by a separate contract

No work begins until both parties have signed a service agreement for that project. That agreement sets out the scope, the fee, the timeline, revision rounds, ownership of the work, and how either party may bring it to an end.

Where these website terms and a signed service agreement differ, the service agreement applies.

06Enquiries

Sending an enquiry does not oblige you to buy anything, and does not oblige us to take the work on. We may decline a project for any reason.

Please do not send confidential material through the contact form. If you need to share something sensitive before a contract exists, ask us and we will arrange a suitable way to receive it.

07Using this site properly

You may read, print and share pages of this site for your own purposes.

You may not attempt to gain unauthorised access to the site or its hosting, interfere with its operation, scrape it at a volume that affects other visitors, or use it to send unlawful or abusive material.

08Intellectual property

The design, code, text, layout and graphics of this website belong to MOB, except where stated otherwise. You may not copy or reuse them without our written permission.

Client names, logos and screenshots shown in our work section belong to those clients, and are shown with their permission to illustrate work we have done.

09Links to other websites

Our work section links to websites we have built for clients. Those sites are operated by the clients, not by us. We are not responsible for their content, their availability, or how they handle your information.

10Availability

We aim to keep this site available, but we do not guarantee uninterrupted access. We may suspend, withdraw or change any part of it without notice.

11Limitation of liability

We are not liable for any loss arising from your use of this website, or from reliance on anything published on it, except where the law does not allow that liability to be limited.

Nothing in these terms limits liability for fraud, or for anything else that cannot lawfully be excluded. Nothing in these terms affects any right you have under the Consumer Protection Act [Chapter 14:44] that cannot be contracted out of.

Liability for work we carry out for clients is dealt with in the service agreement, not here.

12Privacy

How we handle personal information is set out in our privacy policy, which forms part of these terms.

13Governing law

These terms are governed by the law of Zimbabwe, and the courts of Zimbabwe sitting at Harare have exclusive jurisdiction over any dispute arising from them.
